Where this site draws on the structural patterns, rhetorical cadences, or thematic content of publicly available advocacy material, it does so for the purposes of parody and commentary on matters of public interest, pursuant to the Copyright, Designs and Patents Act 1988, s.30A. We cite this provision clearly, simply, and with confidence. It is the one piece of legal knowledge our trustees have retained without formal training. We note this with appropriate humility and also with some pride.

Our legal strategy

Hate Matters has never issued a legal threat. We have written letters that were, in our trustees' assessment, firm. One was described by Duncan as "essentially a cease and desist". It was not a cease and desist. It was a letter, sent second class.

We are aware that organisations working in areas adjacent to ours have pursued critics, academics, journalists, public bodies, and former employees through defamation claims, harassment injunctions, judicial review proceedings, and other mechanisms that are, we understand, quite effective. We have not done any of these things, primarily because we cannot afford to, but also as a matter of principle. Both reasons are real. We do not rank them.

Our legal strategy is: we write letters. We note the responses. We add people to the register. We write again. We consider this proportionate, transparent, and consistent with our values. We also consider it our only realistic option. These positions are compatible and we have made our peace with that.

Complaints

If you have a complaint about this site, we welcome it. We will read it carefully, note it in our records, consider our position, and write back. We note that organisations in our sector have, in similar circumstances, pursued matters through the Information Commissioner's Office, the courts, and other regulatory bodies. We have not done this. We are aware that we could. We are aware that we cannot afford to. Both facts coexist without difficulty.
